谎报性史 未知染艾滋病下捐血 男子获判4个月监禁及1万元罚款

一名男子在未知自己患艾滋病(HIV)阳性下捐血,并谎称自己的性经历,涉嫌违反《传染病法》,周三(2日)被判4个月监禁,及罚款1万元。

为保护其身份,因此不曝光其个人信息。据了解,该名男子为工料测量师,此前他曾有过五次的捐血记录,但在他第六次捐血时,被发现其血液内呈现HIV阳性反应,当时他参与一项于9月30日由卫生科学局所举办的捐血运动,地点在慈济的静思会堂。

该名男子在捐血前必须先填写相关健康问卷,而其中一问题是欲了解捐血者的性史,问及是否在少于6个月内曾与男性发生过性关系?而他的回答则是“无”,而当时医疗人员也向他表明一旦发现说谎,可能会涉嫌犯罪。

卫生部则指,“当我们在问及他的情况时,男子宣称自己并未有性经验,而且他坚称自己并不曾与过任何可能导致HIV病毒的活动。

当检测出他的血液呈HIV阳性时,他也被质疑是否曾接触过任何HIV病毒,他才坦诚自己曾于不同时间与男性发生关系。”

随后,他向卫生部的一名公共卫生官员,坦诚曾与一名身份不明的外籍男性工人在公共场所发生性关系,以及在菲律宾与陌生人发生性关系。后来,他又向另名官员坦诚曾在2017年年中的时候,于长堤坊与一名男子发生性关系。

对此,检方称捐血者所提供的假资料很有可能会对公共健康与安全造成严重损害,因此要求法庭作出判决。

“如果相关受污染的血液被采集了,很有可能会透过输血传送时,将病毒带到受害者身上。”

而其代表律师则表示,被告无法支付罚款,请求法庭宽容处理。

卫生部表示,该名捐血者的血液上被检测出呈现HIV阳性反应,但所幸目前仍未被使用,而所有相关血液也被销毁了。

捐血者在捐血过程提供误导与错误的信息,将可能被判处最高两年监禁以及2万元罚款或两者兼施。
