外籍劳工遭砍伐树木断枝砸中身亡,公司被重罚19万新元

环境美化公司因外籍劳工正执行砍伐树木作业时,未鉴定砍树风险,导致劳工被所砍下的断枝击中身亡,触犯工作场所安全与卫生法令,被判罚款19万新元。

据人力部今日(25日)发文指出,Sin Eng Cleaning Services于2015年8月受雇砍伐位于谦福路(Kheam Hock Road)62号后面空地上的六棵树。8月27日,其公司印度籍加内山(译名,Chinniah Ganeshan)雇员与另两名同事被指派到该区执行砍伐任务。当时他正使用电锯砍伐树木,却遭锯下来了的部分砸中跌落,但因身上吊带和绳索使他悬挂在离地约23米的半空中。

民防部队接获通报后赶往现场,但因非合格的爬树专业人员,所以无法施救。约一小时后,加内山才由附近正在工作的承包商工作人员救下,而由于胸部和颈部伤势过重,于下午4点20分左右当场宣告不治。

经调查后发现,Sin Eng Cleaning Services原是安排采用吊车施工,但碍于工地上有障碍物,吊车无法进入到工地内,因此公司便指示使用人工的方式上树。

对此,公司未对施工现场进行风险评估与采取安全流程,反而是由加内山自行决定工作程序。

另外,公司也被指未安排紧急措施应对紧急情况,例如安排两人以上的爬树工人。加内山是公司唯一合格的爬树工人,因此意外发生后,并没有其他工人可伸出援手。

调查发现,加内山很有可能在砍树的位置上作出错误的判断,导致当树枝断裂时,并未朝预期的方向发展而坠落。

人力部职业安全与卫生稽查处处长陈仕豪指雇主在执行任务时,未能及时评估风险并规避,已严重威胁员工的安全,若采取适当的措施,及时与员工沟通,或许能够避免意外发生。
