公园局称呼建屋局是“产业主” 有权增公共组屋额外规定

前日,英语媒体《今日报》刊载, 一名私人补习老师为捍卫自己在五房式组屋单位内养鸡的权益,和建屋发展局杠上的报导。

据报导,48岁的Eric Woo是一名养鸡爱好者,在家里养了五只鸡,它们分别关在两个笼子里,偶尔才让它们出来在家中走动。他也透过鸡只教育学生有关繁殖和生命周期的知识。

不过,在今年5月,相信是遭人告密,建屋局官员找上门,告诉他当局不准住户在政府组屋里饲养鸡只。

因为担心当局将没收他的宠物鸡,Eric Woo赶紧将五只鸡移到别处,为刚刚孵出的两只小鸡找新主人。

Eric Woo对此感到不满,因为无论他找不到建屋局有规定,不准进行非商业性饲养家禽。

而建屋局回复《今日报》的询问时,坚定表明住户不能在组屋单位养鸡只等的家禽,若允许他们到处走动,也会对邻居造成不便。

不过,Eric Woo相信法律是站在他那一边的。他引述野生动物和鸟类法,表示民众可以在“任何场所内”饲养不超过10只鸟类。

公园局指“房东”有权增额外规定

至于国家公园局指“在政府组屋单位饲养家禽违法”,对此Eric Woo也知情,不过他反问,公园局什么时候对组屋有管辖权了?

《今日报》也征询公园局的答复,不过后者的回应似乎有些“政治不正确”,当局表示,动物和飞禽法令是个广义的法律,而对于Eric Woo的个案,“产业主”(landlord,或可译作房东、地主)–也就是建屋局,有权增加额外规定。

至于该局社区动物管理和兽医部的主任Jessica Kwok表示,“组屋业主仍需遵循“房东”的规定,在相关管理范围内不被允许养家禽。”

公园局说辞“政治不正确”?

等一等,公园局说建屋局才是“产业主”?为了慎重起见,小编查询了牛津和韦氏英语词典,都表示“landlord”的意思,指的是对某区域或物业的拥有者,且可收费让他人使用。

公园局这番回应,似乎就矮化了公共组屋“屋主”的权益。因为过去坊间对于人民究竟是不是组屋的“屋主”都感到怀疑。

过去本社也有报导探讨组屋权益的课题,以房地产专家邱瑞荣为例,就曾在《海峡时报》撰文,呼吁国人改变买房子的思维,实际上国人更像是在租房,一次付清99年的“租金”,只不过是有权利享受99年的租约。

但对此国家发展部长黄循财反驳,公共组屋买家只是租户,不拥有组屋产权的说法,是“不符事实和法理的”。

总理:“卖”给小贩的也是20年租约 99年屋契到期归还公平

黄循财在去年9月出席公共组屋专业建设高峰论坛。接受媒体采访时,他坚称,不论是私有或公共的租赁产业,买家在租赁期间(period of lease),都能对自己的产业行使所有人权益。

“他们可以透过出售房产从中受益,或者出租出去。”

即便总理李显龙也曾以小贩租约来比喻,政府是“卖”20年契约给小贩,这期间小贩可以使用空间经营或租给人,但最后还是归还给政府。

所以,当民众付出一定价钱,向政府(建屋发展局)购买公共组屋时,是买了 99年的屋契。99年期间,这间组屋是你的,你可以用满这屋契99年,这期间你“拥有”这间屋子。

“这公平吗?我认为是公平的!你买产业,我们开价给你,这产业值很多钱,但我们卖给您的是获津贴价钱。你可以自己住,也可以租出去,或者参与政府的屋契回购计划(lease buyback programme)。”

哎呀呀!公园局会不会说了什么不该说的话?所以究竟谁才是组屋的真正“产业主”?
