汶莱下周新刑罚上路:同性恋将乱石砸死 国际特赦组织震惊

汶莱政府根据伊斯兰法修订新刑法,将在下周三(4月3日)生效,届时同性恋和通奸罪,都会以鞭刑或石刑(乱石砸死)的方式,处以死刑。

伊斯兰法仅适用于穆斯林。偷窃初犯者将被截肢右手、再犯者截肢左脚。至于同性恋和通奸都是死罪。该刑法也适用于儿童。

国际特赦组织于昨日发文告,抨击汶莱政府落实伊斯兰刑法新条文,呼吁该国政府应立即停止盖刑罚,并根据人权义务检讨有关法律。

该组织汶莱研究员蕾萩霍华德表示,合法化这些不人道的刑法,是令人震惊的。一些潜在的罪行根本不应被视为是罪行,包括同性成年人两厢情愿的性行为。

上述刑法过去曾饱受批评,被搁置四年后,汶莱检察总长办公室宣布,这些刑罚将在今年4月3日生效。

对于新措施的推行,汶莱国内并没有出现激烈反对声。汶莱苏丹哈桑纳博尔基亚为国家元首,拥有行政全权。

在1967年继位的哈桑纳博尔基亚曾表示,伊斯兰刑事法应作为来自神的“特别指引”的模式,并将成为汶莱“伟大历史的部份”。

2014年落实伊刑法

汶莱在2014年4月实施伊斯刑法,为东南亚第一个实施伊斯兰刑法的国家,当年宣布改变刑法的第一个阶段,其中包括对犯下非婚生子,或是未在周五的主麻日祈祷,都将遭到罚款或是坐牢。

当时,国际特赦组织曾对该法表示关切,认为其中含有不人道和侵犯人权的缺陷,也限制言论、宗教和信仰自由的权利,并造成对妇女和女童的歧视。

汶莱修法有三个阶段,遭到国际社会反对,汶莱延缓了最后两个阶段的实行,但如今又计划继续推行新法。

根据国际特赦组织提供的背景,汶莱虽然签署了《联合国禁止酷刑公约》,但仍未正式承认之,在2014年也全盘拒绝了联合国人权检讨提出的建议。

在国际人权法下,诸如石刑、截肢或鞭打构成酷刑或其他残忍,不人道或有辱人格的惩罚,都应当禁止。

汶莱也没有签署和承认国际上大部分的禁止酷刑虐待人权协议。签署国会受到人权条约制约,实施酷刑行为都会在国际法下构成罪行。
