揶揄梁实轩“博同情” 总理:告梁诽谤非打压言论自由

时评人梁实轩因分享一则报导被总理李显龙提告诽谤,不过控方认为梁实轩成功利用这起诽谤诉讼,成功“博取公众的同情和支持”。

在控方誌期2月11日的证词中,指梁实轩发起群众运动,成功引起民众对这篇不实报导的注意,同时针对梁实轩指控总理滥用司法程序作出反驳。

在证词中,总理表示梁分享的文章报导失实,声称他“涉及腐败,成为一马公司丑闻的调查对象,并和马国前首相那几签署了数项不平等协议,借此透过新加坡银行来为一马公司洗钱。”

总理指出,这是对新加坡政府以及作为政府领导的他,作出的攻击和严重诽谤。

而在梁实轩的证词则指出,他分享的贴文受众有限,比起可能高达15-20万元的诉讼费用,所造成的损失相对低,故此为了极小影响的一则贴文而动辄昂贵的诉讼,乃是滥用司法程序。

梁的辩词也指责总理为了捍卫政府声誉、打压言论自由,透过司法诉讼来传达一个信息,即民众不应批评总理或政府。

对此总理证词反驳辩方的说法, 强调起诉梁实轩并非要打压言论自由,而是政府和金融管理局遭到非常严重和破坏性的指控,为此需要行动来捍卫清白,“作为一个遭中伤的个人,我有权维护自己的声誉。“

总理也说,已经给予梁实轩合理的机会道歉,但对方拒绝这么做。他也表示,任何人包括梁都可以批评他或他的政策,但是无权作出不实的诽谤。

总理也表示,知道梁是知名的评论家,也撰写过许多批评政府政策的文章,但这一次梁作出不实指控,诋毁他的声誉和诚信。为此他希望和梁实轩不要躲避,一同站到公堂上对峙。

针对总理和梁实轩的诽谤案,高庭刚在本月25日(周一)进行聆讯,法官决定针对双方申请保留判决,并将在适当时候公布其书面决定理由。

因为被指在脸书分享一则不实报导,梁实轩被李显龙总理指控诽谤。但是后者在12月底,也透过代表律师林鼎反诉总理滥用法庭程序,并向总理索讨“名誉损害”的赔偿。对此总理代表律师文达星则向法庭申请撤销梁的反诉。
