原定明早绞刑 44岁公民提呈上诉获暂缓

一名44岁新加坡男子协苏海(Syed Suhail bin Syed Zin),因面对贩毒罪名成立,原本将在明日(18日)执行绞刑,不过高庭已允许暂缓执刑。

据人权律师拉维(M Ravi)在脸书更新资讯,高庭已下令暂停后执刑。后者是在今日下午4时,向上诉庭提呈上诉,以进行司法检讨,直至上诉庭聆审协苏海的上诉,后者的执刑将暂缓。

协苏海因涉及贩运近40克海洛因,新加坡高庭在2016年月判后者罪名成立。协苏海无法证明这批毒品仅供他自己食用,而法庭资料也提及,他也把一包海洛因以5千700元价格卖给他人。

在滥用毒品法令(Misuse of Drug Act)下,任何个人若持有超过两克的海洛因,若无法获得证明,即可被视为涉及贩毒用途,而贩毒的刑罚既是死刑。

行刑前八天家人才被通知

今年9月10日,协苏海的家庭接到信函通知,得知他将在本周五被处刑,并提醒家属准备后事。

协苏海亲属大多居住在邻国马来西亚,基于防疫边境管制他们也不得越堤见前者最后一面。协苏海为此写信给律师拉维求助。

据拉维的贴文,明日上诉庭仍无法聆审协苏海的申请,将再另行通知聆审日期。今早,拉维提呈司法检讨申请,乃是有关总统特赦程序的宪法挑战,以及作为新加坡公民的协苏海,申诉公民面对不平等对待,比起其他外籍死刑犯在疫情下暂缓,公民却被急于处刑。

再者,拉维也提呈刑事动议,要求上诉庭重新检讨判决。有鉴于协苏海可能面对精神状况的问题,后者应在滥用毒品法令33B(3)项下下判。

有关条文提及,若被告证明他或她精神异常(不管是否由于逮捕或精神发育迟滞或受伤或其它疾病引起),严重损害主观判断能力,将不考虑死刑。
