滥用职权软硬兼施 夫妇涉嫌诱骗外国女子卖淫

涉嫌逼迫外国籍原舞女卖淫,并“监禁”另两名外国女子,外籍夫妇被控触犯《防范人口贩卖法令》。

一对印度籍夫妇,即31岁的普丽洋卡(Priyanka Bhattacharya Rajesh)以及其51岁的马尔卡(Malkar Savlaram Anant)被控抵触《妇女宣章》,教唆外籍女子进行卖淫,并没收所有薪金和肉金。

他们也在防范人口贩运法令(Prevention of Human Trafficking Act)下,面对三项控状。

两人皆不认罪,而控方在经过上个月的审讯后,要求法官判他们罪名成立。

据法庭文件指出,两人涉及滥用雇主的权力,窝藏并削剥包括受害者在内的三名孟加拉籍妇女自由。

法庭谕令传媒不可刊登受害者们及他们的工作场所。

或首宗涉贩卖劳动力罪案

据《海峡时报》报导,若两名被告被定罪,此案将会是首次在防范人口贩运法令下,本地首宗因“贩卖劳动力”而定罪的案件。一旦被定罪,初犯者将依每项控状监禁不超过10年、罚款不超过10万元,以及不超过六下鞭刑。

案件在昨日审讯,地庭法官赛夫丁(Shaiffudin Saruwan)原定于昨日下判,但是他要求提出更多资料,因此将案件展延到11月15日下判。

控方在早前陈述案情时指出,男被告是驳船码头一带沙球劳路一家夜店的管理者,同时负责在同一条路附近的第二家夜店中招募表演艺人,也负责这两家夜店的日常运作。

男被告也需要到印度或孟加拉寻找歌舞女子,到夜店驻唱,而受聘的歌舞女子都必须争取顾客打赏,只是所有赏金都必须放入夜店提供的箱子里。

原本签约担任夜店舞者

受害者供称,她于2015年12月22日抵达新加坡,原本受雇为男被告负责的其中一家夜店,担任舞者;另外两名孟籍妇女则于2016年来到我国,在另一家夜店担任舞者,三人原定薪水为六万孟加拉塔卡(约965新元)。

控方指出,两名被告滥用身为雇主的权利,威胁受害者及两名女子,若他们想辞职就会给予严厉的经济处罚,并且严密监视和控制受害者的行动和通讯。

三人皆表示,护照和手机等物件在抵达我国后就被没收,然后被安排和夜店的唱片骑士(DJ)同住,天天都要工作。

她们往返住处和夜店都有专车载送,但是不能去其他地方;回到住处后,住处的大门就会被锁上,以致他们无法外出。

受害者指出,在抵达新加坡一个月后,女被告就和她接洽,要求她必须每月获得最少一万元的小费,否则受害者将无法获得全部薪金,甚至教唆和暗示受害者必须和顾客“出门”,进行性交易以赚取更多收入。

受害者坦诚,被骗与三名客户发生性关系,客户们前后都给了她和夜店约5000元、手机及首饰等。但是当她回到住处,其所有财务都被女被告没收。

她最后成功于2016年5月21日至22日期间,成功逃离夜店,而另两名女子也在工作约一个月后,于2016年6月1日停止工作。

女被告强调没参与夜店工作

控方指出,女被告曾在受害者要求返回孟加拉时表示,必须支付40万孟加拉塔卡才能回家。

控方表示女被告曾对受害者进行误导和诱使行动,表示若受害者提供性服务,将可以保留一半的收获款项。受害者随后被说服在不同时段提供性服务,而她的收入则归嫌犯夫妇所有。

审判期间,两名被告答辩时表示,女被告并没有参与任何夜店的工作。

控方指在女被告的睡房中搜出金链和手机,女被告辩称那是其丈夫在夜店中捡到后,交给她的。

男被告也否认有“监禁”三名受害者,并表示住处的大门钥匙就放置在客厅的桌上,受害者随时可以开门外出。他也否认没收她们的手机和护照,并表示没有要求他们签署不平等合约。

被告夫妇目前以每人两万元,获得保释。
