范国瀚举笑脸卡片遭提控 狮城驻美大使称”触法便要执法“

只因为在邻里警局对面举笑脸卡片,以及在法院外拿着一张A4纸张拍照,社运份子范国瀚遭起诉违反公共秩序法第七条文。

此事亦引起外国媒体报导,《纽约时报》的文章形容《只有他和笑脸,就被控非法集会》(It Was Just Him and His Smiley Face. He’s Charged With Illegal Assembly),质疑新加坡为了避免对国家秩序的潜在威胁,而在言论和集会自由上施加严格约束。

今年3月,范国瀚在大巴窑中民众俱乐部(Toa Payoh Central CC)正对面,举起一张画着笑脸的卡片。他此举是为了声援倡议环保议题是的两名年轻人。

范国瀚曾指出,说出真相从来都不应被当成犯法,数十年来的压迫导致恐惧似乎变得习以为常,我们对于政治的不公和公民权益的威胁变得漠不关心。

不过,新加坡驻美国大使米尔普里(Ashok Kumar Mirpuri)亦在本周二(8日)撰文回应《纽约时报》,指责范国瀚在违禁区域以及未申请准证的情况下,进行“集会”,为此触犯了公共秩序法。

“范国瀚大可在演说者角落履行他表达政见的权益,或者刊载他的观点。他也可申请准证。但他没有,如果他选择触法,那么我们就必须执法。”

米尔普里也认为,即便范国瀚只是独自抗议,但如果有数千人未经许可群聚一起,后果将是不同的。

“因此,在人口稠密的新加坡采取的做法是,仅允许在演说者角落进行群众示威(在那里曾进行数以千人的抗议集会),使当局能够评估公共秩序风险。”

米尔普里指出,新加坡对于集会权益,以及“他人不被集会构成不便”的权益之间取得平衡,在捍卫我们的价值上无需道歉。

“我们无意强加于其他国家,相对地他国也应尊重我们的主权。无论如何,我们不认为在美国盛行的“言论自由”给我们带来好印象。”
