质疑含政治动机 林鼎申请停止警方调查遭高庭驳回

今年10月2日11时许,原本正在珍珠大厦办公处,为时评人梁实轩诽谤诉讼作准备的律师林鼎,突然遭有三名商业事务局警员到场,将林鼎逮捕返警局协助调查。

尽管最终林鼎在同日获保释,不过后者也谴责上述逮捕行为,也强调这是有政治动机的。

林鼎因涉嫌失信和非法跟踪一名前雇员的两项指控,被被商业事务局和警察部队调查。为此,林鼎在10月20日入禀法庭,要求法官下令停止一切对他的调查。

不过,高庭法官洪清福昨天(8日)发出判决书,驳回他的申请,也指林鼎未能拿出论据来佐证他的申请。法官强调,总检察署起诉的案件,只有在两种情况下将受到司法检讨,那就是滥用权力或违宪,而原告未能证明这两点。

也是人民之声党领袖的林鼎,申请强制令要求警方停止调查。不过法官指出,在刑事程序法下,警方有责任展开调查,而林鼎未能佐证警方是出于恶意或违反宪法。

对于林鼎指责警察中央分局的调查官Hannah Cheong,以及商业事务局调查官Desmond Toh“串通”,法官则指出,两名调查官已作出解释,他们是邀请林鼎在同一天接受问话,避免为两项不同的指控跑两趟警局。

警方援引刑事法典第309条文的刑事失信罪逮捕他。此外,林鼎在防止骚扰法令(POHA)下,被他的前雇员指控,在任职林鼎的事务所期间被骚扰。

警方称,林鼎之前处理交通事故索赔案的客户,委托律师报案,指控林鼎挪用法庭判给客户的赔偿款项。

9月23日,警方曾要求林鼎出席28日,在广东民大厦的约谈以协助调查。不过警方指林鼎在27日,透过律师表示无意出席警方约谈,林鼎亦指责有关调查存政治动机。

不过,根据林鼎代表律师拉维,在9月28日致给警方商业事务局的信函,表示上述案已在国家法院审理,理应尊重司法程序,而要求林鼎录口供的做法,似乎有悖司法程序。尽管拉维要求警方在当天5时30分前回应,好让他建议林鼎是否出席警局录供,不过当时警方仅表示,将采取必要行动。
