尚穆根指巴蒂未提非法调派经历 惟辩方律师庭上质询却遭阻

前女佣巴蒂被指偷窃,历经四年官司终沉冤得雪,高庭法官陈成安指责廖家指控巴蒂,存“不当意图”(improper motives)。判决引起举国民众关注,朝野议员亦将此事带到国会讨论,针对现有司法制度提出质询,确保公正、弱势者能声张正义。

时隔高庭判决两个月,内政部长兼律政部长尚穆根也于上周在国会发表部长声明。他指在判决后,警方和总检察署展开内部调查,发现巴蒂在2016年10月28日当天被解雇时,只大声告知廖家成员,在短时间内被终止合约,恫言告发到人力部。

尚穆根指当天中介曾两次表示要帮她投诉,但对方拒绝。尚穆根意有所指,指法官在受辩方说辞影响下,推断廖家的报案有动机,但在审理上诉时,还未有出现他所提及的“最新证据”。

巴蒂在2017年9月和10月,即是在被指控偷窃后,正式向人力部提出投诉,指廖家曾非法调派她到住所以外的地点工作。

当询及为何当初检察官不曾将巴蒂向人力部提出的投诉,视为参考证据?尚穆根则表示,那是因为辩方在审前会议未提出,因此也未有深入调查。

控方一度阻巴蒂律师,提出巴蒂有意通报人力部

然而,回溯两年前,阿尼尔曾基于此一关键,与控方在法庭交锋,并称控方阻止阿尼尔提出巴蒂有意向人力部投诉的议题。

本社报道,法官和署理检控官Tan Yanying ,当时认为此事与申诉“毫无关联”。阿尼尔也毫不客气回击,控方不愿此事在法院提及,恐怕是担心“不知后事如何进展。”

阿尼尔也强调,巴蒂向人力部投诉廖文良,与审讯很有关系,也和巴蒂被开除有关联。然而,后来法官也认为,民事程序、人力部进行的调查,都和巴蒂的审讯无关联。

高庭推翻指控,廖氏父子行为存“不当意图”

直至两年后,高庭为巴蒂翻案时,高庭法官陈成安在判词中表示,巴蒂有充足的理由,向人力部作出投诉。她被要求到到廖文良儿子廖文龙住家和办公室打扫,并且两三天的工作内仅受到10元的报酬,这并非合理的报酬。

而且,巴蒂因为不愿意为廖启龙清洁厕所与为他提供餐食,引发两人之间的冲突。对此,高庭法官陈成安也强调,此一安排是有违人力部规定。

根据人力部规定,外籍家庭帮佣只允许为雇主工作,而且工作地点只能在工作许可证上的居住地。除非家庭帮佣有必要被安置在另一个地址,以便在白天照顾雇主的年幼子女或年迈的父母。

非法雇佣外籍家庭帮佣将面临最高1万元罚款,并可能会被禁止再雇佣帮佣。

控方未能证明廖氏报案时不存在“不当意图”

鉴于巴蒂曾明示将会向人力投诉,这很可能让她失去工作,促使巴蒂陷入两难,是选择保住饭碗还是通报人力部。

法官认为,巴蒂的不满颜于表,显然并非自愿为廖氏提供额外的工作,并有理由相信廖氏家族在意识到巴蒂的不满后,先发制人,突然终止她的工作,让她在没有时间打包自己的行李,意图阻止向人力部投诉。

与此同时,在工作结束后,廖氏父子也先下手为强,通报警方,阻止她返回新加坡。

法官表示,“鉴于了解巴蒂通报后的严重性,我有理由相信,廖氏家族很可能会很担心巴蒂向人力部通报。

至于有关物品丢失的理由,法官则认为丢失的物品指的是“多年前”遗失,而不是在终止合同后才出现,因此法官更倾向该行为相信是对巴蒂的威胁。

种种迹象表明,控方未能消除辩方所提出的合理怀疑。法官强调,控方未能证明廖氏报案时,不存在“不正当动机”,尤其是在报案的时间点更是可疑,因为在巴蒂威胁他们后的两天,他们即可报警处理。

然而值得注意的是,尚穆根在国会中所强调的“新证据”,仍未有机会在庭上接受核实。那么内政部所录制的视频,又要表达什么意义?
