被指处理已故总理遗嘱一事“行为失当” 林学芬案料转介三司审讯

本月21日,纪律审裁庭发表裁决报告,裁定李显扬妻子林学芬,为已故建国总理李光耀准备遗嘱一事,专业行为失当,违反律师专业法令。

《海峡时报》星期刊报导引述审裁庭对林学芬妻子措辞严厉的批评,指责后者“不诚实,试图将证据形塑成自己是无辜受害者的形象”,以及“李显扬的行为也同样欺瞒。”

林学芬不同意审裁庭报告将力辩

此前总理弟弟李显扬也在脸书转述妻子林学芬的评述,后者不认同审裁庭的报告,表示届时将在公堂审理时必将力争之。

“群众都能透过律师公会获取有关闭门审裁庭审讯的完整记录。我呼吁群众仔细审视之,以达致他们对此事的独立结论。”

目前,林学芬的案子相信将转介到三司特别庭(Court of Three Judges),这也是我国处理律师失当行为的最高纪律机构。

如经裁定有罪,律师可面对罚款、被停职甚至是直接解除律师执业。

律师公会发言人则在今日(25日)告知《海时》,根据以往经验,从向三司提呈诉讼到审讯,可能需时半年。

律师公会从本月18日起,有一个月时间向高庭提出申请。

若三司另寻,林学芬代表律师届时可力辩为何审裁庭的裁决不正确;然而若三司一经判定,就不能上诉。

律师公会会长维贾延德兰则在昨日表示,在律师专业法令第97条文下,林学芬无权对审裁庭判决申诉司法检讨。只有三司才能审核。

建国总理李光耀在2015年3月23日与世长辞。而上述案件都围绕在林学芬为前者准备最后一份签署于2013年12月17日的遗嘱事项上。

在审裁庭抗辩时,林学芬的辩护律师就曾指出,李光耀为三个孩子平均分配份额都不是“新的注意”,早在2011年的遗嘱就有平均分配的概念,也曾在至少“2013年11月”开始与律师柯金梨讨论此事。

且李光耀是“老练精明的人”,律师辩解李光耀实则很清楚自己要做什么,也惯于他的指示“获得立即执行”。
