国大生犯非礼罪判缓刑遭质疑 法官:不应视缓刑为“判刑较轻”

今年9月,国大生萧凯运(译音)于地铁站和车厢内三度非礼女性大腿和臀部被控上法庭,却因成绩好判处21个月缓刑,引起公众不满,认为判决过轻。法官对此回应,不应将缓刑视为“判刑较轻”的判决。

《海峡时报》报道,地方法官Jasvender Kaur表示,“在21个月的缓刑期间,他必须完成150个小时的社区服务,接受宵禁与参加针对罪行而设置的课程,减低再犯风险,使他能够再重回社会。”

23岁的被告萧凯运(译音)为一名国大生,他承认于去年9月12日晚上11时25分,在乘搭朝榜鹅地铁站方向的东北列车上,用左手触碰一名28岁女郎的双腿以及臀部。

地方法官认为被告在犯罪时显然是不成熟的心智状态,才会犯下罪行,所以目前的判处不仅符合被告,也符合社会最佳利益。

然而,对检察官而言,非礼行为是严重的指控,尤其是发生在公共交通工具上。检察官Deborah Lee和 Benedict Chan评估,萧凯运已符合成年人嫌犯条件,因此缓刑对他而言更像是一起例外,而非常态。

检察官进一步补充道,萧凯运自2016年8月开始,便出现恶习。针对萧凯运过往的行为,其表现并未出现强烈的改变意图,也正因他过去曾在公共交通工具上非礼,而强化了他的犯罪行为,成为根深蒂固的恶习。目前检察官将对判决提出上诉,要求判处6周监禁。

法官称罪行为受害者带来痛苦,但却未有受害者受到心理创伤

对此,法官承认,在公共交通上犯下非礼罪为严重罪行,但即使罪行相当严重,但伤害性质相对较轻,因此更应该注重其后的康复工作。

法官续指,被告将被转介到相关治疗方案,治疗他在社会界限的扭曲及加强是何会技巧与相对的性教育。

而面对检察官的指控,萧凯运的律师则站出来缓颊,强调被告在调查期间全面配合,也承认罪行,且被告的原本就出生于谦逊的家庭背景,是家中的独生子。

针对受害者一说,法官则回应,“尽管这种罪行确实会带给女性痛苦和焦虑,但目前没有任何受害者陈述,以及其他事实证明受害者因此而受到心理创伤,因此并没有“严重伤害”的说法。

与此同时,法官表示她也参考2018年类似的案例,其判决顶多判处两周监禁,而对于控方所指出的过往罪犯行为,基于法律原则,只能针对目前他所承认的控诉进行审判。

“根据我的判断,不能因未构成的指控而将被告处置,仅能凭据他所认罪的指控而判刑”,法官指出。

法官续指,萧凯运过往的罪行并不能视为是加重处罚的因素,加上良好的学习成绩凸显了他未来优秀生活的潜力,因此被列为“拥有强烈的改变动力”,故接受缓刑的判决。

但显然,法官以“学习优良”作为判断未来生活的潜力,对此案的判决与许多人持相反意见,促使公众质疑判决的公正性。

对于非礼案的判决,内政暨律政部长尚穆根在脸书发文指出,自己也对判决“感到惊讶”。

目前他被判缓刑监视21个月,必须自晚上11时至隔日早上6时都待在家中,而且还要执行150个小时的社区服务,并且结束治疗。

为了确保被告在缓刑期间能够表现良好,法官也要求被告父母签保5000元。
