为医罹癌妻丈夫申请转移公积金存款遭拒 人权律师批形同“剥夺他人生存权”

2016年12月,47岁的印裔妇女莎若吉妮,被诊断患有卵巢癌,他们一家为此饱受煎熬,财务状况也陷困顿。

丈夫苏利亚希望能治好妻子的病,向中央公积金局申请,将自己的普通和特别户头存款,转移到妻子的保健储蓄(medisave)户头,好让妻子能继续抗癌。

但是,公积金局拒绝了苏利亚的要求。

莎若吉妮表示,当她得知自己罹患癌症的噩耗,感到很绝望,但她有活下去的意愿,也感谢家人们一路扶持。她的癌症是侵略性的,她必须经历数次的化疗,但即便这样癌细胞近期还是复发了。

妻子已用光公积金积蓄

为了治病和住院,如今她已没有多少公积金积蓄,而且如今已动用丈夫的保健储蓄,已经没有多余的钱来应付医疗开销。

莎若吉妮是在私人医院接受治疗。“此前曾前往国立大学医院征询第二意见,但是后者只是建议:尽量带你妻子到能让她感到开心的地方,也意即他们没有把握医好我。”

她说别无选择下,她只能回到伊丽莎白私人医院就诊,她强调她不是为了奢侈享受,而是该医院至少尽力确保她能活下去。

丈夫苏利亚在接受采访时表示,公积金局不赞同让他提取普通和特别户头的存款,作为治疗妻子的医疗费用。

“即便我告诉他们,我的保健储蓄已经用光了,但他们有条例需遵守,仍不同意我使用上述户头存款。”

“我的妻子在受苦,我留着存款何用?”

“当我的妻子在受苦,那我留着存款又有何用?我的妻子就是我的一切。”

苏利亚每月薪资大约为三千新元。除了医药费,还要应付家里开销,他说有好几次他逾期缴电费,家里点供被中断。最终只能和亲友借钱支付一笔预付额。

为了筹措医药费,苏利亚已经用了一切方法:向贷款公司、亲友、雇主乃至上网众筹。

“我不介意辛苦,我希望妻子能活到79、85岁,看到自己子孙,即便折我寿命给她也心甘情愿。”

在2017年6月,苏利亚为妻子准备了生日惊喜,而且重新宣誓结婚誓约,希望能在妻子抗癌的过程中为她打气加油。

苏利亚说,他也有感到绝望和无助的时候,甚至有轻生的念头,但仍相信上帝会让自己的妻子康复。

对于苏利亚夫妇面对的困境,人权律师拉维认为他们的个案涉及到《公积金法》第18(D)条,也就是让公积金会员可以把普通和特别户头的存款,转移到至亲的户头,但是只能限定在55岁后才能这么做。

“或许当局也同情莎若吉妮罹癌的情况,但照条例,就只能等到丈夫苏利亚年满55岁,在公积金局同意下才可把存款转移到其妻子医疗储蓄户头。”

宪法保障”不得剥夺他人生命或人身自由“

对此拉维感到难以置信,他更引述新加坡宪法第九条文:“除非依照法律,不得剝奪任何人的生命或人身自由。”,指这种情况形同在剥夺莎若吉妮的生存权益。

拉维也批评,这样的公积金条例即不合理,也不符合法律精神,使之无法得益于丈夫的公积金的存款户头转移,来延续妻子的抗癌生存斗争。
