议员吁设理事会监督《防假消息法》 尚穆根:恐致官僚机构“不必要臃肿”

此前,三名官委议员:特斯拉副教授、王丽婷和郭秀钦,对于政府欲推行的《防止网络假信息和网络操纵法案》表达关注,其中也建议应设立独立的理事会,以便监督网络虚假事件,以及监督执法情况。

不过,律政部长暨内政部长尚穆根在昨日的国会辩论中,则反驳三名官委议员的建议,认为再设立一个理事会,恐怕会导致官僚结构“不必要的臃肿”(unnecessary bureaucratic bloat)。

他认为, 国会既是代议士机构,就表示是以民主方式运作,议员可提问并问责监督部长工作。“你不能不断设立机构,那么谁又该去监督这些机构(委员会)的运作?”

他表示理解三位议员善意,可以促进国人对有关课题的持续对话,增进对法案的了解,“但是,设立另一个理事会是最佳方案吗?会否导致官僚机构不必要的臃肿?”

他认为国人必须理解现有体系和机制,有能力执行和应付网络假消息问题,“议员在任何时候有疑问,都可通过国会提问,这些问题都会一一或解答。”

在4月30日,三位官委议员发表声明,列出修正建议包括:

  1. 设立规定行使权关键原则(法案原则,Principles of the Act)的条款,其中包括针对严重错误,而非为打压意见、评论、批评、讽刺、模仿、概括或经验陈述的编篡法案;
  2. 发出的任何指示对公众而言是公开而合理的;
  3. 上诉程序必须迅速;
  4. 设立独立理事会,该理事会的成员由国会特别委员会委任。

不过,尚穆根认为议员提出的原则过于笼统,他表示政府给与更具体的时间表,法案将确保上诉程序快捷,任何人或机构若不满部长的指示,可上网填写表格,提交部长作出上诉。

部长在收到上诉后须在两个工作日内决定是否撤销原有的更正/删除内容指示。上诉者可在14天内进一步申诉到法庭。

而法庭一旦接到上诉,须在六天内对案件展开聆讯,这意味着从部长提交申请算起,最快不超过九个工作日,法庭就会开庭审理。

至于堂费,法庭在聆讯首三日不收费,超出三天才根据“一般价格”收费;法庭也有权豁免收费。

此外,对于外界抨击《防假消息法》赋予部长过大权力,尚穆根反驳,相比现有广播法令和电信法令,新法赋予政府的权力实际更小,而且还赋予法庭更多的监督权。
