香港占中案九名人士遭判刑

2014年的雨伞革命“占中九子”戴耀庭、陈健民、朱耀明、黄浩铭、張秀贤等人(统称占中九子案),因分别占领中环、金钟、尖沙咀等主要地段,争取普选特首等訴求,日前被裁定“公众防扰”罪名成立。

根据法新社和港媒报导,其中港大副教授戴耀廷、陈健民两罪分別判16个月、八个月监禁,同期執行;社会工作者邵家臻、黃浩铭各判八个月监禁,同期執行;牧师朱耀明、時任学联常務秘书长钟耀华、前香港立法会议员李永达则获判缓刑,無需入狱;中大學生會前會長張秀贤被判200小時社会服務令;律师陈淑庄则因健康因素将刑期押后。

宣判后,占中支持者到法院外对着被带离法院的四位领导人大喊“加油”,情绪高涨。

法院亦裁定2014年的示威运动并不在香港言论自由的保障下,因为其示威行动已经侵犯他人的权利。

宣判判决时,法官认为被告者对公众所引起不便与痛苦是毫无悔意,强调道歉是必要的但却未曾获得被告者的致歉。

香港民主发展陷入困境

本次的判决也意味着香港社运与民主发展已然陷入困境。而2014年长达79天的示威运动显示香港人民对领导者的不满与愤怒,尤其是香港的青年人的觉醒。

香港自1997年以来,实行一国两制的政策,虽说維持原有的立法权、行政、独立司法权和终审权,但香港居民仍无资格参与选举,以此抑制了其投票自由权,进而引发愤怒,促使了示威运动的形成。

黄浩铭表示“我们会为民权主义争取到底,永不改变。”。陈淑庄则对着支持者喊道:“我希望香港人民不要失去希望、不要害怕后悔而退缩。”

忧判决“杀鸡儆猴”

香港与中国政府为此控诉,必需对占领主要地段多日而引起各方不便的示威者予以处置。

但维权团体与社会工作者则反驳政府提出公众防扰的控诉理由,措辞含糊,且处以基本法(common law)中最高刑罚,是对付言论自由的“新伎俩”与“非常阴险的打击”。

“此等重罚是想对长期推动民权主义的维权人士产生寒蝉效应。”国际组织中国部资深研究员王松莲表示。

国际特赦组织将四名被监禁的示威运动领导者誉为“良心犯”(prisoners of conscience),而本次判决也开启了同类事件的危险先例,可能会受影响。

“良心犯”(prisoners of conscience)是公元1960年代初人权组织国际特赦组织创造的名词,系指在没有做出国际人权组织所认定的犯罪行为,却因种族、宗教、肤色、语言、性取向、以及信仰等问题而被拘禁。

美国驻港大使馆表示关切香港政府对占中事件的指控;而英国驻港大使馆亦发表对此“表达深度关切”,因为这会阻碍香港人民未来参与和平抗议的走向。

历时79天的雨伞运动(占领中环)为香港史上其中一项最重要事件,以争取普选特首等诉求,提出公民抗民为手段,占领香港金融区主要交通要道,能够公平实践“投票权” 、“参选权”和“提名权”的行政长官和立法会普选。 许多示威者以黄色雨伞来阻挡警方所使用的胡椒喷雾、催泪弹与警棍,故将称之为”雨伞革命”。
