工人党市镇会诉讼结案陈词 律师:“辩方秉持善意行事”

工人党市镇会诉讼,续去年10月初在高庭展开长达17天的审讯,今早再次开庭,让诉辩四方进行口头结案陈词。

阿裕尼—后港市镇会(AHTC)和白沙—榜鹅市镇会(PRPTC)指责刘程强、林瑞莲、毕丹星等八造,必须对2011年5月至2015年11月期间,对第三方承包商的不当付款行为负起责任,并索偿3371万元。

AHTC代表律师在书面陈词中指责,辩方不当付款给民营管理公司FMSS,并指责辩方作为受委托管理市镇会者,违反信托义务而失职。

控方律师也指因为被告的管理不善,导致AHTC在2014年陷入财务困境,但与此同时管理代理公司FMSS的利润却增加300巴仙。而AHTC和总审计署在AHTC的管理上发现供185个“管理失误”。

代表工人党主席林瑞莲、秘书长毕丹星、前党魁刘程强、市镇会理事蔡誌泓和符策涫的高级律师CR拉惹,则针对诉方的索赔额提出质疑。

“应追回款项仅逾62万”

CR拉惹指出,AHTC聘请的审计公司毕马威(KPMG)也总结市镇会共支付了3371万元给FMSS,但毕马威认为涉不当付款仅达151万元,其中应追回款项仅为62万4621元。

CR拉惹指据毕马威审计,其余索讨款项列为“不确定”。

“这表明,对于这些付款,毕马威也无法确定AHTC市镇会是否因此蒙受任何损失,”他引述毕马威新加坡执行董事欧文霍克斯(Owen Hawkes)的话,后者指不可能确定哪些付款应该追回。

“可追回”付款中的60万8911元,是支付给FMSS的项目管理费。毕马威认为这批付款不当,因为不属于“重大周期性维修和重新装修”工作。

但CR拉惹提到,辩方只认同诉方列出应追回的八个项目中的其中两个,其余项目包括诉方不认同应列为“项目管理费”的非周期性工程。

“毕马威未到场视察工程成果”

他指出毕马威即没有到过现场视察这些工程和成果,也没有考虑到过去阿裕尼市镇会还在行动党议员管理下,也把同样事项列为项目管理费。

CR拉惹辩称,即使是控方也不清楚,在他们索讨的3千371万元赔偿,是否有因为“管理失误”而蒙受损失。

AHTC指辩方将10个工程项目中的7个交给LST建筑公司而非DM,多花了279万4560元冤枉钱,但CR拉惹指,DM未必比较便宜。

他也质问,控方过于依赖会计公司毕马威和普华永道的审计报告。控方PRPTC称其审计师为“专家证人”(expert witness)而不是作为事实证人(factual witness),至于AHTC则不太确定他们的立场。

“秉持善意行事”不应被对付

在总结时,CR拉惹强调在此诉讼的情境下,有人未遵守规章,但他质问是否有造成损失?他变成辩方以AHTC最佳利益行事,而委任FMSS,则是当时并没有选择(CPG突然退出);委任LST为建筑师,是因为辩方相信他们能胜任。

CR拉惹也引用《市镇会法》第52条文,指出如果任何市镇会官员或雇员秉持“善意”行事,就不应该面对法律诉讼。“这正是我的客户,在此案中–在管理市镇会艰难情形下所做的。”
