马内阁议决废除死刑 国际特赦组织:全球在关注

马来西亚内阁在昨日议决,将废除死刑,并在下周召开的国会下议院会议,提呈废除强制死刑法案。

马国法律事务首相署部长拿督刘伟强表示,目前政府仍在研讨一些问题,包括那些涉谋杀受害家庭、需调查和聆听各造意见。惟这段期间,所有死刑获暂缓。

刘伟强指出,内阁的看法是完全不该执行死刑。政府已告知特赦局,以研究对被判死刑案件的改判,确保违法者受到适当惩罚。

马国国会下议院将在下周(15日)召开。自今年7月,该国已宣布暂缓执行死刑。

国际特赦组织秘书长库米奈杜(Kumi Naidoo)认为,马国内阁废死的决定乃是一大进展,使之加入全球其他106个放弃死刑的国家行列,彻底放弃这种残忍、不人道和有辱人格的惩罚,全世界都在关注马来西亚。

她指出,过去因为执行死刑,使马国在人权纪录留下不可磨灭污点。对于宽容惩处的申请结果,死刑犯往往被蒙在鼓里,而他们往往在数小时前才得知自己将被处决。

10月10日也是反死刑日,国际特赦组织在文告中提及一名来自马国的死刑个案何有华。他在2005年因贩毒被捕,当时他只有20岁。

在2011年5月被判强制死刑,也曾向法院上诉被驳回。2014年,他向柔佛州苏丹申请特赦,至今仍悬而未决。

国际特赦组织欣慰马国政府实现人权承诺,惟认为该局仍需作更多努力,也希望马国国会能通过废死议案,让死刑尘封于历史中。

新加坡官方仍视死刑为遏制贩毒利器

然而,我国政府仍视死刑为打击犯罪的”工具“。我国外交部长维文曾在2016年,在联合国大会上重申新加坡保留死刑的立场,也坚称死刑在我国获得国人“很高的支持”。

他曾指出,全球虽有不少国家主张废除死刑,但国际社会至今尚未针对是否支持依循正当法律程序实行的死刑取得共识。

“世界上目前没有一项重要的国际条约,列明有关落实死刑的规定,每一个国家都有主权权益和主权义务,根据国内情况决定什么刑罚会奏效。”

至于新加坡内政部长尚穆根则认为”死刑是新加坡控制毒品危机的措施“,认为对毒品采取宽松态度,将使毒品毁掉更多人和家庭。实行死刑是为拯救生命而不得不做的决定。

2014年7月22日,马国青年普拉巴卡兰(Prabagaran Srivijayan)因贩运22.24克海洛英,抵触药物法令第七条文贩毒罪成,并在2014年9月22日,援引相同法令第33条文,被判死刑。

此外,本国56岁公民希山鲁丁,在2016年4月6日,因为贩运34.94克海洛英而被判死刑,成为我国自2012年司法改革以来,第19为被判死刑者,当中有16位死刑犯都涉及贩毒判决。

联合国人权事务高级专员扎伊德胡先曾指出,死刑不是防范或保护人们免受毒品侵害的有效刑法,要有效防范毒品和相关罪行,应专注在加强司法系统。

全球目前仍有50多个国家保留死刑,包括我国、美国和中国。
