新加坡民主党副主席陈两裕,因藐视法庭罪在今年四月被判罚款5000元。 陈两裕基于若罚款超过2000元,他可能丧失在下届大选的参选资格,故此当时要求法官判他坐牢,而不是罚款。但当时高庭法官吴必理也回应若有政治抱负,就更应避免触法。 陈两裕在上月,入禀高庭要求表明上述罪行不会影响他参选资格,理据是藐视法庭罪仅属“准犯罪”(quasi-criminal),有别于刑事藐视(criminal contempt),故此宪法条文不适用于陈两裕身上。 惟这项申请在今早被法庭驳回。在书面判词中,法官艾迪阿都拉(Aedit Abdullah)不同意陈两裕代表律师拉维提出的理据,反驳宪法中所指的犯罪定义很广泛,也涵括藐视法庭。 拉维则引述1988年大选的先例,指当时民主党一位候选人朱腓力(Jufrie Mahmood)即便被判藐视法庭罪,罚款3000元,也可以参选。当时朱腓力是民主党副主席,在该党一个论坛上质疑司法独立。 当时《海峡时报》报导,一位选举官指朱腓力所犯之罪并非刑事,其提名仍可被接受。 但法官指出难以引用该先例,因为当时报章报导未有说明何以选举官允许朱腓力参选的细节,也无正式纪录佐证;再者即便报导正确,也不代表31年后,政府仍需受到有关选举官的立场约束。 根据我国宪法45(1)(e)项,凡在我国或马来西亚法庭被定罪和被罚款至少2000元,或坐牢至少一年,都不得竞选国会议员。 将探讨是否上诉…
